Privacy policy

This Privacy Policy describes how Piedmont Candy Holdings, Inc. and our affiliates and

subsidiaries, including Red Bird (“Red Bird” or “we”) collects, uses, and discloses your

Personal Information when you visit or make a purchase from any website that we own,

license, or otherwise operate and that links to this Privacy Policy (each, a “Site”).

For purposes of this Privacy Policy, the term “Personal Information” means any information that, alone or in conjunction with other information or data, identifies or is linked to a particular individual or household and that is subject to, or otherwise afforded protection under, a data protection law, statute, or regulation. The term “Personal Information” does not include anonymized or de-identified data that is not attributable to a particular individual or household and that is not otherwise subject to a data protection law, statute, or regulation. Red Bird may anonymize or de-identify Personal Information, and such data is not subject to this Privacy Policy, and Red Bird may use such data for any purpose.

 

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. Order information

  • Examples of Personal Information collected: name, billing address, shipping address, payment, email address, and phone number. All payments for purchases are completed using a third-party vendor’s online payment system. Red Bird does not have access to your credit card information and does not store or disclose your full credit card information. Any personal or financial information you provide to our online payment system is subject to the third party’s privacy policy and terms of use, and we recommend you review these policies before providing any personal or financial information.
  • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our advertising partners and service providers including Shopify. 

Customer support information

  • Examples of Personal Information collected: name, email address, and phone number.
  • Purpose of collection: to provide customer support.

Minors

The Site is not intended for individuals under the age of eighteen (18). We do not

intentionally collect Personal Information from children. If you are the parent or guardian

Sharing Personal Information

We share your Personal Information with certain organizations and third parties in accordance with applicable law, including as set out below:

  • We share Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example, we use Shopify to power our online store.   • We disclose Personal Information to marketing and advertising partners who help us to be able to provide tailored advertisements, promotions, sweepstakes, contests and campaigns when you are interacting with Red Bird on our Site, online platforms, on social media, or elsewhere.
  • We may disclose Personal Information if we sell, buy, divest, merge or otherwise reorganize our businesses. We may disclose your Personal Information to the extent reasonably necessary to proceed with the negotiation or with the completion of a merger, acquisition, divestiture or sale of all or a portion of Red Bird’s assets.
  • In addition to the reasons for disclosure set forth herein, we may also disclose your Personal Information upon your consent. 

Behavioral Advertising

We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

Using Personal Information

We use your Personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your Personal Information under the following lawful bases:

  • The performance of the contract between you and the Site;
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;

Retention

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Selling Personal Information 

California residents have the right to opt out of the “sale” of their Personal Information. However, Red Bird does not sell your Personal Information to third parties for profit or monetary or other valuable consideration, and therefore we do not provide opt-out request processes for the sale of Personal Information (because we do not undertake such activities).

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.
